Please read these Terms and Conditions carefully before using or purchasing any artwork or services from the artist. These Terms and Conditions outline the rights and obligations of both the artist and the buyer.
By accessing the artist's website, purchasing artwork, or engaging in any transaction with the artist, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the artist's website or purchase any artwork.
All artwork created by the artist, whether digital or traditional, is and shall remain the exclusive property of the artist. The artist retains all copyright and intellectual property rights over the artwork. No part of the artwork may be reproduced, modified, distributed, or sold without the artist's explicit written permission.
a. Pricing and Payment: The prices of the artwork are as listed on the artist's website or as otherwise agreed upon between the artist and the buyer. Payment must be made in full before the artwork is delivered or shipped to the buyer.
b. Refunds and Returns: All sales are final. No refunds or returns will be accepted unless the artwork is significantly damaged during shipping. In such cases, the buyer must notify the artist within 48 hours of receiving the artwork. (This does not include custom ordered artwork, only prints ordered from the website.)
a. Brief and Agreement: If the artist is commissioned to create a custom artwork, the buyer must provide a detailed brief and reach an agreement with the artist regarding the specifications, deadlines, and pricing.
b. Payment and Delivery: A non-refundable deposit may be required before the artist begins work on the commissioned artwork. The final payment must be made upon completion and before the artwork is delivered or shipped to the buyer.
a. Personal Use: The buyer may display the purchased artwork for personal use, including in their private residence or office space.
b. Commercial Use: Any commercial use of the artwork, such as reproduction, distribution, or display in public spaces, requires prior written consent from the artist. Additional licensing fees may apply.
a. The artist strives to ensure that all artwork is accurately represented on their website. However, the artist does not guarantee that the colors, textures, or other details of the artwork will be exactly as displayed on your screen due to variations in monitor settings.
b. The artist is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the artwork, including but not limited to loss of profits, business interruption, or loss of data.
a. The artist has the ability to cancel the project if the artist deems it neccassary in doing so. Whether it is disruptive or disrespectful behavior, exploitation or not adhering to any of the terms & conditions. In the case where the project is canceled, the client will receive the digital project files of what has thusfar been completed. The 50% non-refunable deposit will not be repayed.
b. If the client cancels the project midway for any unforseen circumstances whether personal, medical, financial, mistakes or misleaded information from the clients side, the the client cannot expect the deposit to be refunded. It is also expected that the client pays any percentaged amounts outstanding if the project has been completed more than 50%.
c. The client also agrees if the project is canceled for any reason per point (b), that the artwork whether physical or digital works will not be send to the client. And will be placed into storage for 1 month, the client has the ability to resume the project by notifying the artist. If the the client does not resume the project after 1 month, the artist has all reserved rights to make ammendmants and resell the work.
d. If by case, the client wants to cancel the project because of the artist himself or the work being produced, please hash out your concern before making any dramatic choices. The artist will always listen and ammend mistakes for the client to get the best possible service available.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where the artist resides. Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
The artist reserves the right to modify or amend these Terms and Conditions at any time without prior notice. It is the buyer's responsibility to review the most current version of the Terms and Conditions before making any purchase.
By using the artist's website or purchasing their artwork, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions.
